Missing-ear patient sues local health service
• 28 Jun 2007 • A 32-YEAR-OLD man from Malaga is suing the Andalucian Health Service after part of his right ear which was amputated in a work accident was lost at the University Hospital.
The man was at work on the Alameda Industrial Estate when a pallet fell on him, cutting off part of his ear.
He was taken to the University Hospital by a friend who had picked up the piece of ear hoping it could be reattached, but on arrival at the hospital, no-one wanted to take it from him, though after much insistence it was handed to a nurse.
After waiting more than two hours, the man was taken to Carlos Haya Hospital for treatment, though not by ambulance as none was available. The next day, the accident victim spoke to the insurance company’s surgeon who said the damaged ear could possibly be repaired. He also told him the missing piece was at the University Hospital.
They went to the hospital and saw the doctor who had initially attended to him, but when he went to look for the piece of ear he returned saying it had probably been thrown away as it was nowhere to be found.
The victim then decided to sue the health service for personal psychological and physical damage, claiming it has affected his life, especially when attending job interviews when would-be employers tend to think the ear was lost in a fight and that he is a problematic person. The health service counter claims the injured man did not take the missing piece of his ear to the hospital, with no record of it being left with a nurse. They say the correct procedure was applied and that after having stitches he was sent to a plastic surgeon at Carlos Haya Hospital.
University Hospital claim he returned several days later demanding his ear be repaired but that by then it would have been impossible even if the piece had been available. When told, the man allegedly decided to file the complaint. | Return to Top
