Court finds in favour of transsexual

A MAN has been fined 90 euros by a Malaga court for slander and ‘maliciously’ insulting his flat-mate who is a transsexual. The incidents occurred when the accused slammed the door to his room when his flat-mate, with whom he did not have a good relationship, arrived and allegedly called her a ‘hybrid, transvestite and prostitute’.

According to the sentence, the man did this ‘voluntarily, directly and maliciously’ resulting in the sentence of a 15-day fine with a six-euro daily quota. If he fails to make the payments, he will have to spend a day in prison for every two daily quotas not paid.

Malaga Colega Association, the gay and lesbian association, have approved of this judicial decision and stated that they hope this will set a precedent for cases of violence against gays, lesbians, bisexuals and transsexuals.

The accused man’s flat-mate stated that she felt relieved by the court’s decision and added: “It is very difficult to be a woman because I feel unprotected.” She also expressed disappointment that the judge did not take into consideration the threats to kill her which were in the police report.
