Mother and bar owner facing sex charges

A WOMAN is on trial for offering a 77-year-old man sexual relations with her mentally-impaired daughter in Alhaurín de la Torre in 2003 in exchange for money and tobacco.

The Public Prosecutor´s Office is seeking nine years prison for the mother, the same length of sentence for the man for sexual abuse, and is additionally requesting that custody of the girl be taken away from her mother for six years.

The man who has already spent four months in prison for this case, was said to be able to offer money, tobacco and other goods in return for sex as he is a bar owner.

It was initially said he acted in lust for the girl, who was 11 years old at the time, with her agreement given her age and mental sickness and that her mother was fully aware of the situation.

However, once in court the woman denied having forced her daughter to have sex with the man and says she was not in her right mind when she confessed to having done so. She claimed her daughter had always been a liar and had been telling neighbours she had sex with an older man.

The girl, who is now fifteen gave short responses to the judge’s questions and confirmed her mother had left her with the man in the bar and she had had sexual relations with him on several occasions. She would not however, testify against her mother.

The 77-year-old says he has a clear conscience and has never had sex with the girl or offered anything to her or her mother. He also told the court that custody of the girl and another two children had been taken away from the woman and her partner several months ago. The mother claims it was because the girl talked of her sexual relations with the older man.

A witness testified that the girl had told him what was going on and that she hated having sex with the man but her mother obliged her to do so to get money for food for the children.
