Town Hall will compensate couple for noise pollution suffered in Benalmadena

A DUTCH couple living in Puerto Marina harbour in Benalmadena will be given 15,000 euros in compensation for the noise level caused by three pubs located underneath their apartment.

According to the Dutch couple, they bought the apartment in 1999 as a holiday home to be used by them during the summer and rent out the rest of the year. The noise generated by the pubs was so extreme that tenants renting the apartment left demanding their money back. The couple also, said they had spent 6,000 euros to soundproof the property which did not fix the problem. Now, eight years later, a court in Malaga has ruled that the Benalmadena Town Hall compensate them for the “noise pollution” they suffered as well as the soundproofing costs. The Town Hall will also, reportedly, pay couple the rent money they where forced to return to the 10 tenants who left saying the noise was unbearable. According to the court, the noise level outside the apartment at times reached 98 decibels which the same level of noise pollution caused by construction work, heavy transport and industrial machinery.

Inside the apartment 71.30 decibels were registered – the same level as in a small industry or workshop which would make it impossible for said tenants to sleep at night as according to the EU the recommended decibel level for sleeping is 55.
