Four doctors accused of negligence

• 13 Dec 2007 •

Negligence? Patient sent home with painkillers.Four emergency service doctors accused of negligence and non-assistance to a person in danger have been called to testify in the case against them at Court number 9 in Malaga. It is alleged by the deceased man’s wife that her husband had been to see a doctor the day before he died because of severe back pain. This doctor, who will also be called to give evidence, allegedly diagnosed lumbago and prescribed painkillers.

Since the pain only got worse, the 66-year-old victim reportedly called the emergency service numbers 061 and 112 up to ten times with no satisfactory response. According to the wife’s statement, the first time her husband called them he was told to wait four or five days until the pain subsided. The wife then claimed that she alerted the Guardia Civil who immediately called for an ambulance.Unfortunately, by the time it arrived, the man had died of an aneurysm, according to the post-mortem.

The defence claim that although the doctors were working in the emergency department at the time, it was the responsibility of their supervisors to decide the order of priority for patients. Many involved in the case believe that the death could have been prevented.
