Error sees accused walk free

A BRITISH paedophile has been released in Malaga due to a legal error, according to local reports.

The repeat offender is accused of sexually abusing three minors in Marbella and had to be set free as the date for his parole hearing was set a year later than it should have been. Legally, the hearing should have taken place this February, but due to an error during the transcription of the sentence, the date was set for the same time next year.

The Provincial Court has applied several measures to prevent him from leaving the country with his passport confiscated and he must appear before magistrates daily.

The 49-year-old, originally from Slough, was in preventative custody in Alhaurin de la Torre prison while awaiting trial, accused of raping a young girl in Marbella. He was originally arrested in 2005 after police, investigating the rape, found sufficient evidence to link him to the crime.
