Couple sentenced for building illegal holiday complex

MALAGA Provincial Court has sentenced a couple to three years in prison for building a tourist complex on non-urban land in Alfarnate. It was considered proved that they built a two-storey house with the intention of running a rural tourism complex on which they planned to build more smaller houses on the same plot, as well as creating a communal area.

The couple has been sentenced to demolish, at their own cost, the work which has been carried out, and restore the terrain to its original state, “hence re-establishing the urban planning law which they broke”.

The judge considered that the couple was “fully aware” of the fact that they were building on non-urban land, and they also did so without the necessary permits.

The town hall ordered that work cease after the police discovered the building in 2004, however, the accused failed to obey, and demanded that the town hall grant him a license.

Further decrees were also ignored by the couple.
