THE Mayor of Benamargosa has been acquitted of charges of territorial planning crimes.
Malaga Provincial Court has confirmed the sentence of a Malaga criminal court which acquitted Jose Gallego who had built a two-storey house with a swimming pool on non-urban land without a municipal license in 2001. This was before he held a public position.
Two former Partido Popular councillors who authorized the building and the municipal architect have also been acquitted once again.
The first sentence had been appeal by Malaga public prosecutor who was asking for a year in prison for Gallego under the premise that his actions constituted a crime.
However the courts believe that it has not been sufficiently proved that he acted against urban planning laws.
Gallego has said that he is very satisfied with the outcome of the trial and accuses the public prosecutor of “persecuting” him.
