High price for Fuengirola accident

Fuengirola.

A driver has been sentenced to pay €335,757 in compensation to a man who he hit on the A-7 motorway in March 2011.

 

The plaintiff was driving a van along the A-7 towards Cadiz when he lost control of the vehicle in the area of Fuengirola and left the road, hitting a safety barrier on the right and the central reservation on the left.

He then got out of the vehicle, which was in the left lane, without using a safety jacket.

The driver of a car in the left lane swerved to avoid the van, lost control of his vehicle and hit the van and its driver who was standing in the road and sustained several injuries which have left him unable to work.

A court in Fuengirola sentenced him to pay a fine of €300 and the victim was awarded compensation of €534,050.

However, the sentence was appealed, and the amount awarded in compensation has been reduced as the accident was partly the plaintiff’s fault for not using triangles or a safety jacket.
