THE developer Enrique Ortiz has had his claim for compensation from San Vicente Town Hall dismissed.
An Alicante court threw out Ortiz’s demand for €4.4 million compensation for a failed car park his company built in San Vicente. He built the underground facility in exchange for running it for 35 years. It opened in 2008 but lost money and was not widely used, which Ortiz blamed on the town hall and asked for compensation.
The town rejected the request, claiming that the losses were due to the way that Ortiz ran it. The developer responded by renouncing the contract in January 2014 with the car park now run by the town hall.
The court ruled that Ortiz cannot ask for any form of compensation on a contract that no longer exists.
