THE Department of Health will have to pay €110,000 in compensation to a woman who was infected with hepatitis C while she was in the maternity wing of Alicante General Hospital giving birth. The Supreme Court has upheld the patient’s claim of malpractice brought in December 2013 in which she said that medical staff had not taken sufficient care to protect her from infection. She was treated in the same delivery room where a woman who had hepatitis C had undergone a Caesarean section, resulting in cross contamination between the two women. In awarding compensation the judge took into account the claimant’s age and the long-term damage to her liver caused by the disease.
