Ecologists urge council to demolish El Algarrobico

EL ALGARROBICO: Should be demolished quickly.

SALVEMOS MOJACAR ecologist group has declared that Carboneras Council is the only competent body able to order demolition of the illegal hotel in El Algarrobico and asked it to go ahead and do so as quickly as possible.

After Carboneras mayor Salvador Hernandez recently declared that his council was not responsible for ordering the demolition, the ecologist group reported last week that it had checked the law and found that it is.

While Hernandez argued that the council was only responsible for ordering demolition of ruined or deteriorated buildings, which is not the case of the hotel, Salvemos Mojacar claims otherwise.

The group bases its claims on article 183.5 of the Andalucian Land Law, which states that: “the council or department with town planning competencies will order immediate demolition of constructions which are manifestly incompatible with planning laws in a maximum of one month.” It also pointed out that a High Court sentence last year declared that local councils were the only bodies with the legal capacity to order demolitions of this type.
