RINCON de la Victoria has seen its long fought battle defending the Telephone Antenna Ordinance overturned.
Rincon council has been waging a seven year long battle defending its 2012 agreement that allowed the installation of mobile phone aerials to residents’ homes and municipal building without the home owners consent.
The council appealed a previous ruling by the High Court of Justice of Andalusia (TSJA) but the Supreme Court has confirmed the initial decision in a ruling last month.
Many residents protested which led to a judicial investigation and finally a hearing before the Fifth Section of the Contentious-Administrative Chamber of the Supreme Court.
The Supreme Court has now thrown out the legislation, calling the 2012 agreement “contrary to the legal system.”
Municipal sources are now said to be abiding by the ruling and will not appeal the decision.
Rincon will now abide by provincial regulations relating to telecommunication procedures until a new municipal legislature is drafted.
