The relevant paperwork that you will require includes:

  • Valid Passport or a national identification document to verify your identity.
  • NIE (Número de Identificación de Extranjero), which is a tax identification number. This is necessary for various transactions, including property purchases.
  • Title Deed (Escritura), which is the official document proving the seller’s ownership of the property.
  • Nota Simple, which provides detailed information about the property, including ownership, any outstanding debts or mortgages, and other relevant details.
  • Property Tax Receipts (IBI). The seller should provide receipts showing that the property tax (Impuesto sobre Bienes Inmuebles) has been paid up to date.
  • The organisation of the Notary appointment and all paperwork related to the sale.
  • Translation at/of the Notary.
  • Calculation of 3 per cent retention.

What are the steps to buy a property in Moraira?

The first step is careful planning and research. Be sure to explore different areas and property types, and communicate with your estate agent about your budget, expectations, and requirements.

Once you are sure about the area you would like to purchase a property, you then need to arrange viewings through your chosen estate agent. Your agent may book multiple appointments over a few days to make the most of your time – be sure to take plenty of photos and make note of the pros and cons of the property!

Spain is notorious for paperwork and documents, particularly when applying for residency or buying a property, so it’s essential that you have everything in order. You will also need to get your NIE Number (Numero de Identidad de Extranjero), open a Spanish bank account, and find a good lawyer or tax advisor, your estate agent may be able to help you with all of these things.

Now you’ve chosen your property and arranged all of the relevant paperwork, it’s time to make an offer! It is highly recommended that you make an offer through your estate agent, and this must include the offered price, proposed payment terms, and deadlines. If you are looking to negotiate on the price, it is much safer to do this through your estate agent and this will give you a better chance of getting the property you want for your desired budget.

Once your offer has been accepted, it is time to sign the reservation contract, a purchase contract, and complete an official deed at the Notary.

Much like purchasing a property in the UK, there are a variety of mortgages available which will differ according to your interest rates, repayment periods, and initial starting fees. Whether you choose a variable-rate mortgage or fixed-rate mortgage, it is essential that you hire a professional to fully understand the mortgage agreement you sign. Once the date has been set for your signing, you have three days to visit the Notary – an impartial public servant who provides free legal advice.

Once everything has been completed at the Notary, you have paid the applicable taxes, and submitted the new title deed to the Land Registry, you will need to make sure that all utilities, such as water bills, electricity bills, community fees, and council taxes, are changed to your name with the appropriate bank details.

Finally, you will need to register your new home with the property registration. To do this, you will need your NIE Number, payment of ITP tax confirmed, and a copy of the vendor’s IBI tax payment.
