No retrial for jailed killer – Sevilla, Spain

NEVER FOUND: Marta del Castillo killed by boyfriend.

THE confessed killer of Sevilla teenager Marta del Castillo could have his jail sentence extended.

Marta, 17, went missing on January 24, 2009.

Sevilla Provincial Court sentenced her ex-boyfriend, Miguel Carcaño, to 20 years in prison last year. Carcaño confessed he had killed her during an argument at his home after hitting her over the head with an ashtray.  However, he denied knowing where her body was.

This sentence was revised in November, and since then, the Supreme Court has twice delayed their decision due to the “complexity of the case.”

However, this week, it was announced that the trial would not be held again, but that Carcaño’s sentence should be increased for causing suffering to the family by repeatedly changing his story regarding where the body was located.  He will also have to pay the €616,319 it has cost to search for Marta’s body.

The Provincial Court sentence considered it proved that Carcaño and a friend known as El Cuco, who was sentenced as a minor (under 18) for covering up the crime, put Marta’s body in a wheelchair and disposed of it with the help of an unknown third person.

Carcaño was sentenced to pay €340,000 to Marta’s family for moral damages, as well as the legal costs, and is banned from living in the same city or town as her parents or sisters for 30 years. His older brother, his brother’s girlfriend and a friend, Samuel, were all acquitted. Now, the sentence against Samuel will also be revised.
