Mallorca taxi driver who sexually assaulted British tourist avoids jail after court plea deal

A taxi driver in Mallorca has been convicted of sexually assaulting a British tourist after picking her up following a night out in Magaluf.
The 29-year-old driver admitted the offence in a Palma court and was sentenced to pay a fine rather than serve time in prison after reaching a plea agreement.
The incident took place in the early hours of October 3, 2023, when the 33-year-old woman, who had been drinking on Magaluf’s Punta Ballena strip, attempted to return to her nearby hotel. A friend hailed a taxi to ensure she got back safely.
Instead, the journey took a disturbing turn.
Route changed and victim taken to Palma airport
According to court documents, the tourist initially sat in the back of the taxi while her friend told the driver where to take her.
Shortly after setting off, the driver stopped the car and insisted the passenger move to the front seat and pay the fare in advance. She complied and paid by card.
Rather than driving to the hotel, however, the driver diverted onto the motorway heading towards Palma Airport.
During the journey, prosecutors said he took advantage of the woman’s intoxicated state and touched her breasts and groin over her clothing while attempting to kiss her.
When they arrived at the airport, the driver allegedly told the victim: “This is how things are done in Spain, so get used to it.”
Court sentence: fine and compensation
Although prosecutors had initially sought a prison sentence of around three years, the case was resolved through a plea bargain.
The court ultimately handed the driver a financial penalty of around €2,880 and ordered compensation for the victim after he admitted the offence and paid damages.
Judges considered the payment of compensation as a mitigating factor in the sentencing.
Victim required psychological treatment
Following the incident, the British woman required psychological support.
According to court documents, she experienced anxiety, depression and recurring flashbacks after the assault.
The case has sparked debate online and among local residents about the punishment handed down in sexual assault cases and the safety of tourists travelling alone late at night.
Concerns for tourists and expats in Mallorca
While serious crime remains relatively rare on the island, incidents involving vulnerable tourists occasionally make headlines – particularly in nightlife hotspots such as Magaluf.
For expats living in Mallorca, the case serves as a reminder of the importance of using licensed taxis, travelling with friends where possible and ensuring someone knows your route home after a night out.
Authorities continue to encourage anyone who feels unsafe or experiences harassment to report incidents to police immediately.
